Imposing Sanctions on Members for Non-Compliance with the Association's Code of Professional Ethics
Any member company of the Association is expelled from the Association following a proposal by the Administrative Board and a related decision by the General Assembly, after submitting a written report to the member who committed the violation, outlining the acts/actions that the member undertook which contravene the Association's Charter as well as acts against the general well-understood interest of the Association.
Any member who discontinues their activities for a period longer than six months or loses their professional license automatically ceases to belong to the Association and is officially removed following a written notice from the Secretary of the Association.
A member that has been removed is entitled, upon reactivation, to submit a new application to the Secretary of the Association for re-registration. The application will be reviewed by the members of the Administrative Board, based on all the criteria governing the registration of a member in the Association.
If, in the opinion of the Administrative Board, a member of the Association has violated:
- any article of the Constitution, or
- any resolution of the General Assembly,
they will be subject to expulsion following a decision of the General or Extraordinary General Assembly with the vote of 2/3 of the present members who have the right to vote.
It is understood that for this measure, the specific member will receive a relevant written notification-letter from the Administrative Board, at least 15 days before the convening of the General or Extraordinary General Assembly, so the member has sufficient time to prepare to explain and defend their position.
Any member of the Administrative Board who falls from their duties following a majority decision of the Administrative Board for negligence of duty, incompetence, misconduct, refusal to execute the decisions of the General Assembly or the Administrative Board, or for another sufficient cause. However, it is understood that this member will have the right within 15 days from the date of their removal to appear and defend their position before the Administrative Board before a final decision is taken.
The Administrative Board can remove from the Association any member that ceased to possess:
- permanent and licensed facilities for weighing and measuring ready-mix concrete materials as well as
- the appropriate vehicles (truck mixers) for the transportation and delivery of the concrete.
Excluded are only the members who temporarily interrupt their operations.
